English Abstract:
This study examines maqāṣid-based jurisprudence in the thought of Shaykh Usman dan Fodio (d. 1232 AH), highlighting his contribution to understanding the objectives of Islamic law within the Maliki scholarly tradition of West Africa. It investigates how he employed these objectives to interpret religious texts, explain legal rulings, and address religious and social concerns. Using inductive and analytical methods, the study collects and examines relevant passages from selected printed works and available manuscripts, situating them within his intellectual formation and engagement with earlier jurists.
The analysis addresses four interconnected themes: the five essential objectives and their hierarchy when competing interests arise; legally recognized welfare and the prevention of harm; facilitation and the removal of hardship; and the identification of effective causes underlying legal rulings. Particular attention is given to his prioritization of religion, life, intellect, lineage, and property, alongside his treatment of reconciliation, migration, and communal worship. These examples demonstrate how broader legal purposes inform particular rulings and their application.
The findings indicate that dan Fodio did more than transmit earlier scholarly positions: he explained, interpreted, and contextualized them through purposive legal reasoning. His writings reveal engagement with authorities including al-ʿIzz ibn ʿAbd al-Salām, al-Qarāfī, al-Suyūṭī, and al-Shaʿrānī. The study presents his contribution as an underexplored link in the development of maqāṣid scholarship between al-Shāṭibī and Ibn ʿĀshūr. It concludes by recommending further collection, critical editing, and systematic analysis of his manuscript heritage to establish a fuller account of his legal thought and its significance within West African Islamic scholarship.
