This paper critically examines the implications of Islamic marital rights on spouses within Yobe and Borno States, Nigeria. The study explores the socio-economic, cultural, and religious dynamics affecting the enforcement and perception of these rights. It highlights the challenges posed by poverty, displacement, and patriarchal norms while offering recommendations for fostering equitable marital relations. The analysis is grounded in Islamic jurisprudence, socio-legal frameworks, and qualitative field research. The failure of marital rights in Yobe and Borno states, Nigeria, has profound socio-economic and psychological implications. In a region already ravaged by insurgency, poverty, and displacement, the erosion of marital rights exacerbates gender inequality, domestic instability, and the breakdown of family structures. This paper examines the causes and effects of marital rights failures in the context of Yobe and Borno states, focusing on issues such as forced marriages, abandonment, lack of spousal support, and gender-based violence. The study draws from a combination of field research, literature reviews, and socio-legal analyses to highlight the multifaceted challenges faced by women and men in marital relationships. Recommendations are offered to address these challenges through legal reforms, cultural reorientation, and targeted interventions by governmental and non-governmental organizations. The paper concludes by emphasizing the need for a collaborative approach to restore marital stability and protect the rights of all parties within marriage in these conflict-affected regions.

يتناول هذا البحث بالدراسة والتحليل الآثار المترتبة على الحقوق الزوجية في الإسلام بالنسبة للزوجين في ولايتي يوبي وبرنو بنيجيريا. ويستكشف البحث الأبعاد الاجتماعية والاقتصادية والثقافية والدينية التي تؤثر في تطبيق هذه الحقوق وفهمها داخل المجتمع، مع تسليط الضوء على التحديات الناجمة عن الفقر، والنزوح، والأعراف الأبوية، وبيان أثرها في تحقيق العدالة بين الزوجين. ويرتكز التحليل على مبادئ الفقه الإسلامي، والأطر القانونية والاجتماعية، إلى جانب نتائج البحوث الميدانية النوعية.
كما يوضح البحث أن الإخلال بالحقوق الزوجية في ولايتي يوبي وبرنو يخلّف آثارًا اجتماعية واقتصادية ونفسية عميقة، في منطقة تعاني أصلًا من تداعيات التمرد المسلح، والفقر، والنزوح القسري، مما يسهم في تفاقم عدم المساواة بين الجنسين، وعدم الاستقرار الأسري، وتفكك البنية العائلية. ويناقش البحث أسباب هذا الإخلال وآثاره، مع التركيز على قضايا الزواج القسري، وهجر الزوجة، وغياب النفقة والدعم الأسري، والعنف القائم على النوع الاجتماعي. واعتمدت الدراسة على منهج يجمع بين البحث الميداني، ومراجعة الأدبيات العلمية، والتحليل الاجتماعي والقانوني، للكشف عن التحديات المتعددة التي يواجهها كل من الرجال والنساء في الحياة الزوجية. كما تقدم مجموعة من التوصيات الرامية إلى معالجة هذه الإشكالات من خلال الإصلاحات القانونية، وإعادة توجيه الوعي المجتمعي، وتفعيل أدوار المؤسسات الحكومية ومنظمات المجتمع المدني. وتخلص الدراسة إلى التأكيد على أهمية تبني مقاربة تشاركية تسهم في استعادة الاستقرار الأسري، وصون الحقوق الزوجية، وحماية جميع أطراف العلاقة الزوجية في المناطق المتأثرة بالنزاعات.
